By using our service, members understand that they are authorising us to arrange the purchase on their behalf. This means that they have given us full authorisation to forward their payment to a third party agent (tobacco product supplier) on their behalf. Members are fully responsible for any or all orders they place through the Smoker Club.
We are not a tobacco shop, we do not carry stocks of tobacco products in any form or quantity. Payment solutions are provided by outside agencies not associated with The British Smokers Club. The Smokers Club is a non-profit organisation, it does not profit from the sales of tobacco products, although, we do receive 5% of order value, as a donation toward the general overheads and marketing costs of the club from the tobacco suppliers/agents.
Our members understand that the payment providers they use (Netpay) to make their purchases, act on behalf of the member and not the club, and they are in no way responsible for any purchases made through the club, and are only responsible to ensure that the members funds are forwarded and arrive to the Smokers Club, in order that the club can arrange the third party agent to make the purchase, package and post the items on behalf of the member. The Smokers Club does not handle the purchase, packaging or posting of any tobacco products.
It is further agreed by members, that any monetry or order disputes must be made through the Smokers Club. The payment providers simply provide a method of payment forwarding for our members, and are not responsible for members funds once they have been sent to, and received by the Smokers Club.
Orders are sent by recorded delivery, proof of which can be provided. All orders are purchased, packed, and posted by a 3rd party agent approved by the Smokers Club.
The Smokers Club assumes responsibility to obtain proof of purchase and postage, from the agent, if so required. Any dispute will be resolved by the club after full investigation with the agent and relevant postal authority.
Note: In accordance with EU law, all tobacco products are ordered by clients as gifts for family and friends.
No further duty or tax is payable on gift items as long as they have been purchased inside the EU by a private person residing within the EU, and given to another private person also residing within the EU. It is illegal to sell these gift items, any person found doing so by us, will be refused further orders from us, and may be liable to prosecution.
The Smokers Club is located outside the EU in order that the British Government cannot put any undue pressure on the club to cease helping its members.
Members agree that upon submission of their order, they fully agree, understand and abide by these terms.
